No guide is copyrighted. They'd have to be published first.

There are things we can do to get people to take stolen guides off their sites or give credit where it's due, though.
Once it's online, it's published and is therefore protected by copyright. While you aren't required to include a copyright notice in your guide, it helps.
GameFAQs has a good article on this that applies well here, or anywhere on the Internet. It also has links to other sites about copyright.

In fact nobody is gonna sue them, it's just the host that is gonna close his site for breaking the ToS.

He didn't update it to the new guide. Anyways, good for the people that made their guide late. They didn't got stolen. Btw, I wonder if he even pays attention to the subforum guide
